Missouri Court of Appeals Affirms Judgment
Just weeks before the hearing, the firm was retained by Viacom Outdoor, Inc. to argue an appeal before the Missouri Court of Appeals in Viacom Outdoor, Inc. v. St. Louis Supermarkets, et al. The case involved registration of a foreign judgment in Missouri against three separate companies, all of which received advertising pursuant to a contract with Viacom. Two of the companies sought to vacate the foreign judgment, arguing the foreign court did not have jurisdiction because they were not parties to the contract with Viacom.
Hilary H. Sommer, one of our lawyers in our St. Louis office, successfully argued that the trial court was correct because appellants had failed to show the absence of an agency relationship between Viacom and the appellant companies. The Court of Appeals agreed, affirming the decision.
